Last Friday, attorneys FJ Maloney and Nick Thede received a defense verdict in favor of their client from a Benton County, Washington, jury following a five-day trial. In the case, captioned Vanderburg v. Alpha Prop. & Cas. Ins. Co., Cause No. 13-2-03002-8, the plaintiff alleged that the insurance company breached the policy when it refused to pay a claim following the alleged theft of his vehicle. The insurance company denied the claim on the ground that the insured failed to cooperate in the investigation and misrepresented material facts concerning the claim. At trial, the insurance company presented evidence that the insured failed to provide a stipulation to obtain the cell tower records and misrepresented his location during the relevant period. At the conclusion of the trial, the jury ruled in MLR’s client’s favor, finding that the insurance company did not breach the policy when it denied the claim.
